Miller Beach Surf Club ZBA Hearing-A Full Time Catering Facility/Restaurant

It has been brought to our attention in the last few days that a ZBA hearing concerning the Miller Beach Surf Club is being held Sept 26th (#14 on the agenda) beginning at 3 PM.

The request is for a: Certificate of existing use for existing clubhouse building with cellar entrance, one story frame office/storage building and one family dwelling with covered porch: existing Clubhouse deck, awning, alterations, deck attached to one story frame office/storage building, gazebo and detached shed extension of non-conforming use: also, front yard setback variance for existing detached sign not permitted in residential zone.

Our civic board has voted NOT to support this special permit request.

The Miller Beach Surf Club has entered into a lease with Miller Beach Club, Inc. to utilize the existing club as a full time catering facility and restaurant. The non conforming use for this residential property since 1942 is Property class 417-Cabin. These improvements may have already been made by the leaseholder without site plan reviews, or certificate of occupancy and they have been found in violation of these and other sections of Brookhaven Town Code on April 19, 2006.

1. The Miller Beach Surf Club, located at 23 Harbor Beach Rd, MP, has filed an application for a Building and Zoning Permit with the TOB Building and Fire Prevention dept.
2. The TOB ZBA hearing is scheduled for Sept. 26, 2007 at One Independence Hill, Farmingville, NY (Auditorium 2nd floor).
3. The Miller Beach Surf Club is in violation of multiple Brookhaven Town Ordinances and has been summoned as of April 19, 2007.
4. The Miller Beach Surf Club. Inc was filed on May 14, 1942 with NYS as a Domestic Not-For-Profit Corporation.
5. The Miller Beach Club, Inc. was filed by Steve Spillotis on Oct. 21, 2005 as a Domestic Business Corporation.
6. The Miller Beach Surf Club currently operates a website at www.millerbeachsurfclub.com and advertises as a catering facility in newspapers.
